The plaintiff abandoned her lawsuit resulting in its dismissal with prejudice. Evidence was developed showing plaintiff praised the accused supervisor’s workplace conduct and that she even expressed gratitude for the overwhelmingly positive experiences working for him.
  • Torretto v. I.B. Diffusion, L.P., obtained a not guilty judgment for a company and its president against Title VII sexual harassment claims alleging damages in the tens of millions of dollars for a hostile environment, sexual assaults and other allegations in the United States District Court. The case involved the use of cutting edge technology and numerous experts including psychiatrist, psychologist, human resource experts and experts in the field of audio enhancements. The expert in the field of audio enhancement computerized a recorded statement between the Plaintiff and the Defendant which was initially inaudible but upon being enhanced helped demonstrate weakness of Plaintiff’s claims when used on cross examination with a strike system that was invented to assist confronting Plaintiff with prior admission she had made by placing them on a large screen. The not guilty under the facts and circumstances was the subject of numerous articles and periodicals discussing the result as well as the technology that was used.
